Environmental Prosecutions

Chambers is recognised for the provision of specialist advice and representation concerning environmental crime.

Our advocates provide advice to a wide variety of organisations and officials suspected of committing environmental offences, from the earliest stages of investigation through to criminal prosecution or other enforcement action.

Members are instructed in prosecutions concerning the pollution prevention and control regime, the water regime, the waste regime, controlled activities, planning and wildlife offences over many sectors including manufacturing, construction, energy, public utilities and agriculture. 

Our counsel advise on non-prosecutorial procedures pursued by the Scottish Environmental Protection Agency (SEPA), local authorities and other public bodies, including enforcement undertakings, final warning letters, statutory notices, and civil sanction.

Members also provide advice and representation concerning environmental licensing, in particular permissions affecting waste management and controlled activities.
