HMA v SIR ROBERT McALPINE LIMITED
In October 2013 an employee of SRM Ltd lost his life in the course of his employment as a result of a fall from height which occurred after the deceased had crossed a scaffolding barrier during the course of the construction of the Glasgow School of Art, and fell from a staircase, then in the course of construction and which did not have edge protection. Following an investigation by the HSE, SRM Ltd were charged on indictment with offences under Section 2 of the HSWA 1974, Regulation 3 of the MHSW Regulations 1999 and Regulation 22 of the CDM Regulations 2007, alleging a failure to undertake a suitable and sufficient assessment of the risks presented by the staircase, and thereafter to provide adequate information to employees and signage to warn of hazards. Following a trial at Glasgow Sheriff Court which concluded on 12 March 2018 SRM Ltd were acquitted of all charges.
