Hearings now taking place by Video in Outer House
The Scottish Courts and Tribunal Service has confirmed that it will now be possible to conduct hearings in the Outer House of the Court of Session by video rather than by telephone.
Clerks of Court have started to contact parties to indicate that WebEx hearings are now on offer for procedural business. This should extend to Debates and substantive hearings in Judicial Reviews.
The Court of Session is prepared to contemplate proofs as well, where appropriate and where parties agree. Unfortunately, the approach of the Court in the absence of agreement is unclear at the moment and will have to be addressed on a case by case basis.
