Such cases can arise from breach of contract, negligence, or under the law of nuisance or product liability. They can arise in a number of different contexts, from major construction contracts to disputes between neighbours.

Disputes may centre round structural defects, botched building or engineering works, domestic or commercial activities giving rise to damage, contaminated land, fire, flooding, and a wide range of other factual situations.

Our property damage advocates can advise on the prospects of success in such litigations (for pursuer or defender), the conduct of cases including consideration of subsidiary issues such as prescription/limitation, insurance and measure of damages, and on ways of avoiding litigation altogether, including arbitration and mediation.

In this area, as in others, Compass is happy to accept instructions on the basis of Direct Access via the applicable Faculty of Advocates rules. We aim to provide a service which is practical, efficient, and cost-effective.
